This fabulous document presents what you must know for civil litigation arising from torts (injury complaints). It provides the following information:
1. Causes of action - the reason to sue somebody.
2. Elements of each cause - law requires the initial complaint pleading to specify each element of the cause, or by law the respondent can force the court to dismiss for "failure to state a claim [cause of action] for which relief can be granted."
3. Case citations - precedent law in Florida in support of the cause, elements, or defenses.
4. Defenses - the affirmative defenses the respondent may use in order to defeat the complaint. Last chapter includes additional general defenses allowed under rules of civil procedure.
